STONEY CREEK TRAVEL (TRAVEL AGENCY) AND ITS AGENTS ACT ONLY AS AN INTERMEDIARY, IN GOOD FAITH, BETWEEN TRAVEL VENDORS AND TRAVELERS FOR THE ARRANGEMENT OF TRAVEL-RELATED SERVICES AND PRODUCTS.  Our liability is limited to:

* Making every effort to find vendors who are known to be reputable at the time of  recommending their service and at the time of booking a reservation.

* Forwarding timely client deposits and/or final payments to vendors to secure reservations.

* Checking accuracy of reservation documents received by Stoney Creek Travel. 

* Timely forwarding of vendor reservation documents to clients when they are received by Stoney Creek Travel.  Verifying receipt of reservation documents when they are sent directly to clients.

* Informing clients of known vendor cancellation/penalty policies.

* Informing clients of any reservations changes made known to Stoney Creek Travel by vendors.

* Assistance with refund requests and/or complaints to suppliers, if applicable.

* Providing accessibility to travel insurance. Travel insurance is strongly recommended in order to protect travelers from losses resulting from nonrefundable expenditures that are covered by travelers insurance.

* Telling clients where to access information on the Internet or by phone regarding traveler warnings issued by the U.S. Department of State, US Customs requirements, CDC information, TSA information, airline baggage policies, and travel documents that are required for their journey or providing printouts of Internet pages if requested by the client.

*  Providing assistance with destination information, upon request.

International: Passport and/or Visa (Depending on Country)

USA Travel By Air:
Government-issued Photo ID (driver's license or ID, for example). Children need certified birth certificate
You may be asked to show the credit card used to purchase the flights.

TRAVEL INSURANCE: Travel Guard Insurance has several policies.  It is highly recommended that you purchase travel insurance to protect your travel investment.  Accidents are not planned.

Stoney Creek Travel has no control over any vendor and does not have inside knowledge about or participate in running their businesses or forming their policies.  STONEY CREEK TRAVEL AND ITS AGENTS SHALL BE HELD HARMLESS AND NOT REPONSIBLE FOR ANY ACTS OR OMISSIONS COMMITTED BY A VENDOR.  This includes, but is not limited, to a vendor's employees, sub-suppliers and sub-supplier employees. This also includes, but is not limited to: vendor provisions such as:

service quality or quantity
product quality or quantity
rate changes after booking
reservation scheduling and changes which might cause cancellations/interruptions/delays
safe handling of traveler's personal belongings
traveler safety and security
willful or unknown omissions or errors
errors in judgment
failure to comply with any/all domestic and/or international laws
failure to provide paid-for reservations
insolvency, receivership, bankruptcy, liquidation or similar condition
acts that cause loss /damage /delay/ inconvenience injury / illness /pain and/or suffering
insolvency/receivership/bankruptcy/liquidation or similar condition of any/all vendors.
unfavorable insurance underwriting decisions
condition of equipment or accommodations
construction failures or difficulties
failure to forward travel documents on time

Stoney Creek Travel does not guarantee or warranty anything supplied or offered by a vendor (such as but not limited to vacation packager, tour operator, motor coach company, airline, rail transportation or the vendors employees or sub-suppliers and their employees.)

STONEY CREEK TRAVEL IS NOT RESPONSIBLE FOR REFUNDS OF ANY MONEY DUE TRAVELERS BY ANY TRAVEL VENDOR OR FOR INCREASED CHARGES BY ANY TRAVEL VENDOR.  ANY REFUNDS RECEIVED BY STONEY CREEK
TRAVEL FOR CLIENTS SHALL BE FORWARDED TO THE CLIENT IN A TIMELY MANNER AFTER THEY ARE RECEIVED FROM THE VENDOR/SUPPLIER, LESS ANY FEES OR MONEY OWED TO STONEY CREEK TRAVEL.

STONEY CREEK TRAVEL IS NOT RESPONSIBLE IF CASH PAYMENTS SENT TO VENDORS DO NOT ARRIVE ON TIME BECAUSE OF DELAYS OR LOSSES CAUSED BY THE POSTAL SERVICE OR SHIPPING COMPANIES.  WE ARE NOT RESPONSIBLE IF TRAVEL DOCUMENTS DO NOT ARRIVE IN TIME  FROM VENDORS BECAUSE OF DELAYS OR LOSSES CAUSED BY THE POSTAL SERVICE OR SHIPPING COMPANIES.

STONEY CREEK TRAVEL DOES NOT GUARANTEE CLIENTS WILL HAVE A GOOD TIME.  We have no control over and shall be held harmless and not responsible for circumstances beyond our control before/ during/returning from a trip, such as -- but not limited to:

*  Trip cancellations/ interruptions/ delays/ inconveniences of any kind and all conditions or circumstances that prohibit travel from taking place such as, but not limited to: labor strikes, 
terrorist activities, social unrest/disputes/riots/war, epidemics, quarantine, dangers at sea, fire.

*  Climatic weather conditions

*  Accommodation/transportation/excursion/sightseeing/food conditions and availability, including overbookings and poor service or negligence by vendor(s).

*  Client safety and well being. Stoney Creek Travel shall be held harmless and not responsible 
for fraudulent use of client credit/debit or phone card, any and all injuries, accidents including   but not limited to loss of limb/eye or any other body part, incidents resulting in coma or a  vegetative state, or death that may occur, property damage, acts of God, illness, robbery,  theft, pilferage, medical regulations, acts of government.

*  Client failure to comply with international or domestic laws.

WE HAVE NO CONTROL OVER THE ACTIONS OF CLIENTS:  Client responsibilities include, but are not limited to:

*  Understanding the laws of all destinations AND stopover destinations and following those laws. This includes, but is not limited to Customs regulations. Stoney Creek Travel will be happy to assist you upon request.

*  Making sure correct travel documents such as passports/visas are obtained for all destinations AND stopover destinations  including being able to re-enter the United States with proper proof of citizenship.  Upon request, Stoney Creek Travel will provide you with information on proper documents.

*  Making sure Stoney Creek Travel is provided with traveler names EXACTLY as they appear on passport/visa OR certified copy of birth certificate/driver's license.

*  Making sure correct inoculations and vaccines are obtained for entry to destinations and stopover destinations  including those required for re-entry to the United States.

*  Verifying flight schedules and travel times:  24 hours in advance for flights within the USA; 72 hours in advance for flights to/from international destinations.  You can access information at the websites listed under #5 above or by phone at: Delta 800-325-1999; US Airways 800-428-4322; American Airlines 800-242-4444; Northwest Airlines 800-225-2525; Continental Airlines 800-525-0280; Air Tran 800-Air-Tran (800-247-8726); American Trans Am 800-247-8726. If you need phone numbers for contacting these airlines while you are out of the USA, please request information from Stoney Creek Travel.

*  Keeping travel documents, money and credit cards safe and secure.

*  Notifying Stoney Creek Travel of any special needs required for the trip  including but limited to diet, special equipment, handicapped rooms.

*  Obtaining adequate travel insurance.

*  Clients must assume responsibility for making sure they are informed about the places and conditions in the places they will travel. Stoney Creek Travel is not responsible if you venture into unsafe areas in the areas you are visiting. Upon request, Stoney Creek Travel will attempt to assist you in obtaining this information.

*Clients must use reasonable caution to safeguard themselves and their property.

IN SUMMARY, WE ARE NOT RESPONSIBLE FOR ANYTHING THAT WE DO NOT DIRECTLY PROCESS OR PROVIDE.  WE ARE NOT LIABLE FOR YOUR ACTIONS OR THE ACTIONS OF OTHERS. WE DO NOT HAVE THE RESPONSIBILITY OF INFORMING YOU OF EVERY THING THAT MIGHT HAPPEN TO YOU OR MIGHT GO WRONG ON YOUR TRIP.

In the event any paragraph of this agreement shall be declared invalid or void by any court, such
declaration shall not invalidate the entire agreement and all other written parts shall remain in full force and effect.  The parties agree any claim or litigation arising out of or relating to this agreement, or the breach or validity thereof shall be governed by the laws of North Carolina.  Any disputes will heard by the appropriate federal and/or state courts located in Buncombe County, NC.

Participant agrees that in the event that any civil proceeding, arbitration, mediation or action of any kind, is commended by the signor against Stoney Creek Travel or any of its agents, the limit on damages (which includes but is not limited to damages, interest, court costs, attorney fees, expenses of litigation, and punitive damages) shall be the amount the individual participant paid for the trip indicated on the Terms and Conditions Agreement Signature Page.  Participant also agrees that any claims made after one year of travel shall be considered null and void.

These terms and conditions may be modified at anytime without prior notice.  It is the client's responsibility to inquire about any information (s)he feels is important and pertinent to their reservation / trip.

IT IS STONEY CREEK TRAVEL'S POLICY THAT EACH CLIENT WHO AGREES TO BOOK A RESERVATION WITH STONEY CREEK TRAVEL HAS A COPY OF THESE TERMS AND CONDITIONS AVAILABLE TO HIM/HER PRIOR TO THE CLIENT'S MAKING A DEPOSIT OR FULL PAYMENT ON ANY TRIP. 

MANY TIMES ONE PERSON BOOKS A TRIP FOR SEVERAL PERSONS (CO-TRAVELERS).  THE PERSON BOOKING AND PAYING FOR THE TRIP IS RESPONSIBLE FOR MAKING SURE HIS/HER CO-TRAVELERS HAVE THE DETAILS OF THESE TERMS AND CONDITIONS PRIOR TO PAYMENT BEING MADE ON A RESERVATION.  IF HE/SHE IS NOT ABLE TO MAKE SURE HIS/HER CO-TRAVELERS HAVE ACCESS TO THESE TERMS AND CONDITIONS, THEY MUST REQUEST THAT STONEY CREEK TRAVEL SEND A COPY TO THE CLIENT'S CO-TRAVELERS.

MAKING A DEPOSIT OR PAYMENT ON A TRIP CONSTITUTES AGREEMENT WITH STONEY CREEK TRAVEL'S TERMS AND CONDITIONS BY THE CLIENT WHO BOOKS THE RESERVATION AND BY HIS/HER CO-TRAVELERS.

You may make bookings online on http://www.stoneycreektravel.com  if you ae at least 18 years of age and can enter into binding contracts (our site is not available for use for minors).  You will be financially accountable for all uses of our site.  Booking online constitutes a legitimate reservation or purchase. You may not use our site to make any false, fraudulent or speculative reservation or any reservation in anticipation that you might travel.  Stoney Creek Travel is not responsibile for any problems that persons may encounter by booking directly online through our website.  We are not liable for any credit card fraud or scams that occur, since we have no control over these bookings.

You may not post any unlawful, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornogrphic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law; or for any other purpose that is unlawful or prohibited by these Terms.

We cannot promise that our site will be available 24 hours a day / 7 days a week.  We cannot promise that our site will be error free, that defects or errors will be corrected or that our site or the servers that make it available are free from viruses or other harmful components.  You will not use any device, software, or routine that interferes or attempts to interfere with the normal operation of our site or take any action that imposes an unreasonable load on our or our host company's computer equipment.

If a court finds any of these terms to be unenforceable or invalid, that term will be enforced to the fullest extent permitted by
applicable law and the other terms will remain valid and enforceable.  Your continued use of http://www.stoneycreektravel.com and its sub site pages constitutes agreement with these terms.  If you take any legal action relating to your use of our site or these terms, the state of North Carolina will govern thse terms and conditions and you agree to file in the state of North Carolina, Buncombe County.  In any such action or any action we may initiate the prevailing party will be entitled to recover all legal expenses incurred in connection with the action, including but not limited to costs, both taxable and nontaxable, and reasonable attorney's fees.
